Arbitro Terms of Service

By subscribing to Arbitro and submitting payment, you ("Customer," "you") agree to be bound by these Terms. If you do not agree, do not subscribe.

1. What Arbitro Is

Arbitro is an AI-powered lead recovery assistant for local service businesses. It captures and responds to inbound inquiries (via SMS, web chat, and voice) on your behalf, qualifies leads, books appointments, and stores conversations in your portal.

This is an early-stage product. Features are being built and improved on an ongoing basis. We are transparent about what is fully live, what is in development, and what is planned. Before subscribing, confirm with us which features are available for your use case.


2. Subscription Plans and Fees

2.1 Monthly subscription

Your subscription fee is charged at the start of each billing cycle via Stripe. Plans are month-to-month unless you have elected an annual plan. Prices:

  • Lead Recovery: $199/month (Founding Members Only) · $299/month (Non-Founding Members)
  • Dispatch Engine: $599/month (Founding Members Only) · $799/month (Non-Founding Members)
  • Annual plans receive two months free (billed as 10 months).

2.2 Phone number provisioning — pass-through at cost

Your plan includes one (1) phone number at no additional charge. This number is provisioned through Telnyx, our telecommunications provider.

Additional phone numbers are available and billed to you at the exact cost Telnyx charges us — no markup. The current Telnyx rates are approximately:

  • Local phone number: $1–$3/month (varies by area code)
  • Toll-free number: $2–$5/month (required if you want a 1-800/855/888/etc. number)

We will tell you the exact monthly cost of any additional number before provisioning it. You authorize us to pass that cost through to your Stripe payment method on a monthly basis. Number provisioning costs are non-refundable once the number is activated.

Toll-free note: Toll-free numbers cost more per month and may require additional carrier registration. If you want a toll-free number, request it and we will confirm pricing before proceeding.

2.3 10DLC compliance fees

For SMS delivery via local numbers, federal regulations require a 10DLC campaign registration. This is a one-time setup cost (~$15) plus an ongoing monthly fee (~$10), shared across all customer numbers on the same messaging profile. We absorb this cost into the subscription — it is not passed to you separately.

2.4 Voice and call costs

Voice infrastructure is provided through Telnyx. Per-minute call costs are included in your subscription at current usage levels. If your usage creates meaningful per-minute charges above our assumed baseline (approximately 200 voice minutes per month for Lead Recovery), we will contact you before any additional charges and discuss options.


3. What's Included in Each Plan

Your subscription gives you access to the features described in our current offer sheet, which we maintain at arbitrohq.com/pricing. Features marked as "coming soon" or "in development" are not guaranteed for any specific delivery date. We will deliver them as they are ready.

We will never charge you for features that are not yet built. If a feature you were specifically relying on is not yet live, contact us and we will discuss your options, including pausing your subscription.

Weekly summary: For all active accounts, Victor (Arbitro's founder) will personally send you a weekly text or email summary of what your agent captured that week. This is done manually and is part of the white-glove experience we provide to our founding clients. It will become automated as the platform matures.


4. Plan Limits

Soft cap policy: If your usage significantly exceeds the conversation caps above, we will contact you before taking any action. We will never cut off your service without warning. We will discuss whether your plan needs to be adjusted or whether the usage is a short-term spike.


5. The 30-Day Guarantee

If Arbitro does not capture at least one qualified lead or booked callback from a routed channel in your first 30 days, your next month is free.

Conditions:

  • At least one inbound channel must be active and receiving real traffic (SMS number provisioned and working, or web chat widget installed on your site)
  • "Qualified" means the AI captured a name or contact info from a real prospect — not a test conversation from you
  • The guarantee applies to your first 30 days only, not subsequent months
  • Refunds are not issued — the credit applies to your next billing cycle

6. Founding Member Price Lock

If you subscribed at a founding member price ($199/month for Lead Recovery or $599/month for Dispatch Engine), that price is locked for you as long as your subscription remains active. Specifically:

  • Price is locked: Your monthly rate will never increase while you remain subscribed
  • Features are not locked: The features included in each tier will evolve as the product grows. Founding members get access to all features in their tier as those features ship — at no extra charge
  • The lock breaks if: You cancel your subscription. Resubscribing after cancellation is at the then-current public rate
  • Annual plans: If you are on an annual founding price plan, the locked rate renews at each annual renewal

7. What We Do Not Guarantee

  • Specific booking conversion rates. The AI will qualify and attempt to book appointments. Whether a prospect actually books depends on factors outside our control (their budget, timing, your pricing, your availability).
  • Delivery of every message. SMS and voice delivery depend on carrier networks, phone number registration, and recipient device behavior. We use industry-standard providers and compliance practices, but 100% delivery is not achievable.
  • Uptime SLA. We do not currently offer a formal uptime SLA. For founding clients, we respond to outages personally and as fast as possible.
  • Specific feature delivery dates. Features in development will ship when they are ready and tested.

8. Your Responsibilities

  • Provide accurate business information for your agent's knowledge base and persona
  • Do not use Arbitro to send spam, unsolicited marketing, or any communication that violates the TCPA, CAN-SPAM, or applicable regulations
  • Maintain an active calendar connection if you want appointment booking to work
  • Do not use Arbitro to impersonate another business, collect information fraudulently, or engage in any deceptive practice
  • Respond to escalated leads promptly. When the AI flags a conversation for human takeover, check your portal. The AI will flag it — it will not chase you.

Outbound outreach — consent and permission (important). Arbitro does not cold-call or cold-text. The service places calls and sends messages only to leads who expressly opted in to be contacted by you — for example, by submitting one of your lead-generation forms, responding to an opt-in advertisement, or otherwise affirmatively requesting contact. You represent and warrant that, for every phone number, contact, or lead you load into, connect to, or allow to reach Arbitro (including via CRM integrations, lead-ad webhooks, file uploads, or manual entry):

  • you have obtained the lead's prior express consent to be contacted by phone call and/or text message at that number, consistent with the TCPA, applicable state telemarketing and two-party-consent recording laws, the CAN-SPAM Act, and any other applicable law; and
  • you will promptly honor any opt-out, do-not-call, or revocation-of-consent request, and will not re-load a number after consent is withdrawn.

You are solely responsible for the lawfulness of the outreach you initiate or enable through Arbitro and for maintaining records of the consent you obtained.

Violations of these responsibilities may result in suspension or termination of your account without refund.


9. Data and Privacy

Conversation data (messages, lead information, contact details, and appointment records) is stored in our Supabase-hosted database. We use this data solely to operate the Arbitro service for your account. We do not sell your data or your customers' data to third parties.

Meta / Instagram data: If you connect a Facebook Page or Instagram account, Meta's data usage policies apply in addition to ours. We will notify you when Instagram DM integration becomes available and walk you through the connection process.


10. Cancellation and Refunds

  • Cancel any time from your billing portal or by emailing victor@thereinegroup.com
  • Cancellation takes effect at the end of your current billing period — no mid-cycle refunds
  • Annual plan refunds: if you cancel an annual plan within the first 30 days and the 30-day guarantee conditions are not met, we will issue a prorated refund for unused months, minus any provisioning costs already incurred
  • Phone numbers provisioned on your behalf are released on cancellation and cannot be ported unless you specifically request it before cancellation

11. Changes to the Service and These Terms

We may update these Terms as the product evolves. We will notify you by email at least 14 days before any material change takes effect. Your continued use of Arbitro after that date constitutes acceptance of the updated Terms.

We may add, modify, or remove features from plans over time. We will not remove a feature you are actively relying on without giving you at least 30 days' notice and an option to cancel with a prorated refund.


12. Limitation of Liability

Arbitro is provided "as is" at this stage of development. To the maximum extent permitted by law:

  • Our total liability to you for any claim is limited to the amount you paid us in the three months preceding the claim
  • We are not liable for lost revenue, lost bookings, or business losses resulting from AI responses, missed messages, or service interruptions
  • We are not liable for any damages arising from your use of the service in violation of these Terms
  • We are not liable for any call, text, or other outreach made to a lead or phone number that was contacted without proper consent. Because Arbitro acts on the leads and numbers you provide or connect, you are responsible for ensuring each lead opted in (Section 8). You agree to indemnify and hold Arbitro harmless from any claim, fine, or penalty (including under the TCPA or state telemarketing/recording laws) arising from outreach to a lead or number for which the required consent was not obtained.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any disputes will be resolved in the courts of Burlington County, New Jersey.
